ISLAMABAD: Islamabad High Court (IHC) on Tuesday declared all the buildings constructed in violation of the federal capital master plan in the areas of Bani Gala and Sector E-11 to be illegal.
A three-judge bench headed by Justice Athar Minallah, comprising Justice Aamer Farooq and Justice Mohsin Akhtar Kayani, announced the decision on the petition of illegal constructions in upscale Bani Gala and Sector E-11(Golra Revenue Estate).
The apex court ruled that the constructions done in cited vicinities against the master plan are illegal and liable to be demolished.
A 72-page written decision was issued by the court on the matter.
The court’s judgment stated that illegal constructions disrupted the master plan and benefited the privileged class of society.
The petitions filed by a resident Shehzada Sikandar-ul-Mulk along with other citizens challenged the constructions in Bani Gala and Sector E-11. The petitiones claimed that commercial buildings in Bani Gala and tall buildings in Sector E-11 had been constructed in violation of the master plan.
