The MQM resigned from all its seats in the Senate, National Assembly and Sindh Assembly recently in protest against what they described as a campaign of victimization against them in the ongoing operation in Karachi.
Petitioner Syed Zafar Ali Shah, affiliated with ruling Pakistan Muslim League-Nawaz (PML-N), has argued in the plea that the MNAs, senators and MPAs of MQM have tendered their resignations and also confirmed it in their statements.
“Now the speakers of national and provincial assemblies and Chairman Senate have no powers except to notify the approval of the resignations and send a reference to the election commission about vacancies in assemblies and the Senate,” the petition said.
“But the speakers and Chairman Senate violating the constitution by not issuing such notification.”
The petitioner has pleaded to the apex court to declare the seats vacant and suspend the perks and previleges enjoyed by the MQM members till final decision on the petition.
